Refund Policy for Content Creators/Advertisers:
This Payments and Refunds Agreement (the “Agreement”) is entered into by and between Delilah’s House (“Company”) and the Advertiser (“Advertiser”). This Agreement governs the terms and conditions of payments and refunds for advertising services provided by Delilah’s House.
1. One-time Yearly Registration:
– The one-time yearly registration fee is non-refundable.
– Once paid, the registration fee cannot be refunded under any circumstances.
2. Monthly Subscription for Membership:
– The monthly subscription fee is non refundable.
– If monthly subscription is canceled, all future reoccurring/auto payments will non longer be charged.
– You can cancel your monthly subscription at any time.
– Upon cancellation, you will lose your verification status and will need to re-verify.
– To regain verification, you will be required to pay the yearly registration fee again.
– Your membership year will start from the date of re-verification.
3. Profile Deletion:
– If you choose to permanently delete your account, your profile information will be deleted.
– Upon deletion, your subscription will also be canceled.
– You will have a grace period of seven days to reactivate your account.
– If you reactivate within this period, your information will be restored.
– After the grace period, your information will be permanently deleted and cannot be recovered.
Please note that the refund process for any eligible refunds is subject to the policies and procedures of your bank or financial institution. The refund of funds back to your bank card will be handled by your bank or institution, and the processing time may vary. Typically, the refund process takes 3 to 5 business days, but it depends on your bank or financial institution. We recommend contacting your bank or institution for further details on their refund policies and procedures.
Any reports of fraud or attempts to fraudulently receive a refund for the membership or monthly subscription fee will be disputed. We take such reports seriously and will investigate any fraudulent activities. It is important to note that by agreeing to the terms and conditions during the verification process, you acknowledge and accept these refund policies, and any fraudulent activities will be addressed accordingly.
4.1 Advertising Offerings and Charges
To publish Advertisements, the Advertiser must select one or more of Delilah’s House’s advertising offerings and pay the applicable charges and fees. The charges and fees associated with the different offerings, once selected, are prominently displayed at the time of purchase. Such charges and fees are subject to change at Delilah’s House’s discretion at any time. Such charges and fees are incorporated herein by reference.
4.2 Refunds and Credits Advertisers:
No refunds or credits (which include credits, adjustments, coupons, “DelilahsHouse dollars,” and the like) are provided by Delilah’s House and none should be expected by the Advertiser. However, to the extent Delilah’s House does provide a refund, Delilah’s House, at its sole discretion, will either (i) issue a credit back to any credit or debit card used to pay for the advertising service; or (ii) issue a refund check which will be mailed to the current address of record as reflected in the Advertiser’s account. Such refund check must be presented for payment to a financial institution within sixty (60) days of issuance, or such check (and the refund amount) will be canceled and forfeited, and no replacement check will be provided. To the extent Delilah’s House does provide or post a credit to the Advertiser’s account or has provided a credit in the past, in each case, for any reason whatsoever, such credit must be used no later than (i) sixty (60) days of being posted to the Advertiser’s account; or (ii) prior to termination of this Agreement. Otherwise, the credit will be canceled and forfeited, and no replacement will be provided. Any overpayment will be posted as a credit and handled in accordance with this paragraph.
4.3 : Payment Responsibility:
The Advertiser bears full and sole responsibility for ensuring that each payment is appropriately and adequately marked such that Delilah’s House is able to apply such payment to the Advertiser’s account and Advertisement. The Advertiser must contact Delilah’s House promptly if the Advertiser believes that such payment has not been applied correctly. If Delilah’s House is unable to apply a payment within sixty (60) days after its receipt, such payment is forfeited, becomes the property of Delilah’s House, and will not be refunded.
4.4 Variable Fee Model:
If the parties agree that the Advertiser will pay for Advertisements based on a variable fee model such as impressions, clicks, exposure, conversions, and the like (e.g., banner ads), the Advertiser must pay Delilah’s House a non-refundable retainer fee in advance. At the end of a reporting period, as determined by Delilah’s House in its sole discretion, Delilah’s House will submit to the Advertiser a report documenting the calculation of the advertising fee and such fee will be deducted from the retainer amount. Delilah’s House’s records, files, statistics, and reports will be the only basis for the calculation of the advertising fee and are not subject to audit. Any questions concerning such calculation must be submitted within five (5) business days of Delilah’s House submitting the report to the Advertiser or such fee calculation will be deemed final. The parties acknowledge and agree that a variable fee model as described above is a common method for calculating an advertising fee between independent internet businesses and does not mean and does not imply that Delilah’s House owns, controls, or has any influence over the Advertiser’s business. The Advertiser has sole and complete ownership and control over its business.
4.5 Financial Institution and Vendor Fees:
The Advertiser acknowledges and agrees that the Advertiser’s financial institution or vendor may impose a fee on the Advertiser for the use of such financial institution or vendor’s credit/debit card or other payment method. The Advertiser understands that domestic and/or international merchant processing may be used by Delilah’s House and as such, additional international fees may be added. The Advertiser is advised to understand such fees in advance as the Advertiser is solely responsible for payment of such fees, and the Advertiser should consider such fees when choosing a payment method and specific credit/debit card as fees do vary.
This Agreement constitutes the entire agreement between the parties regarding the subject matter hereof and supersedes all prior agreements and understandings, whether written or oral, relating to such subject matter.
